Introduction

Wis. Stat. s. 23.33 allows all-terrain vehicles (ATVs) and utility terrain vehicles (UTVs) to operate on a county highway in certain cases. An ATV ordinance must be enacted by a municipality before operation may occur. For the remainder of this webpage, ATVs and UTVs will be labeled collectively as ATVs.

ATV route designation on county highways

Outagamie County adopted ordinance no. 50-353to allow for ATV usage on county trunk highways. See below for steps on how to apply for an ATV Route Permit.  

The following steps shall be completed prior to the Town, Village, or City applying for a permit. (See ordinance for specific details)

  1. A public hearing on the proposed ATV/UTV route shall be held. The notice of public hearing shall include the time and location of the hearing, a map depicting the proposed route, and details on how public comment can be submitted in addition to verbal comment at the public hearing.
  2. Written notice, by mail, shall be provided to all property owners abutting the proposed ATV/UTV route, and shall include, at minimum, a copy of the public hearing notice as described above.
  3. Official action shall be taken during a public meeting of the municipality’s governing board or designated committee, to authorize said municipality to apply for ATV/UTV route designation.
  4. Any municipality in which the segment of a county roadway being proposed as an ATV/UTV route exists must have adopted the regulations in paragraph (5) of County Ordinance Section 50-353.

 

Once these steps have been completed, the Town, Village, or City may apply for a permit through the County’s online permitting system, Cityview.
